1. Deposits are required to hold a horse/foal for a buyer and to take it off the market. Deposits
are $500 and non-refundable. Details of agreement, such as payments, payment due dates, and
deadlines will be put in writing in a Purchase Agreement.
2. Several forms of payment are accepted: Cash, Cashier’s Check, Money Order, Wire Transfer,
Zelle Bank Transfer, PayPal, and personal or business checks. However, both personal and business
checks will only be accepted if they clear the bank before the horse/foal is picked up.
3. Vet exams prior to purchase are welcome, but at buyer’s expense. Seller will provide vet
exams required for out-of-state travel at seller’s expense.
4. Seller is not responsible for accidents, injury, or illness to foals/horses during the payment or
boarding period prior to the foal/horse being picked up. If a foal/horse dies during the payment
period, then money paid toward the purchase of that foal/horse may be applied toward the
purchase of a different foal/horse, as available.
5. Transportation of the foal/horse is the responsibility of the buyer. Buyer can personally pick
up the foal/horse, or can send a hired transporter to pick up the horse. The buyer chooses the
transporter and assumes all responsibility and risk during transport. Buyers are allowed up to
30 days to pick up the foal/horse after purchase and after the foal is weaned. The 30 days begins the day Buyer and Seller agree to the sale.
6. Ownership of foal/horse will remain with the seller along with any Registration papers,
Registration applications, and/or transfer until after foal/horse has been paid in full and picked
up. The foal/horse will not be allowed to leave seller’s property until paid in full.
7. When a Buyer purchases a foal/horse from Black Forest Quarter Horses, LLC, the above
‘Terms of Sale’ along with any additional ‘Purchase Agreements’ the Buyer and Seller agree
upon will immediately apply. All Foals/Horses are sold ‘As Is, Where Is’ unless other written
guarantees are given. Broodmares can come with a “Live Foal Guarantee” which can be put in
writing. Buyer will be notified of any previous injuries or illnesses to all foals/horses. All sales
will be governed by the laws and courts of El Paso County in Colorado if a disagreement arises.
